1. Sponsor
KHN Solutions LLC dba BACtrack ("Sponsor"), 200 Green Street, 2nd Floor, San Francisco, CA 94111.
2. Eligibility
The BACtrack View Monthly Review Sweepstakes (the "Sweepstakes") is open only to legal residents of the 50 United States and the District of Columbia, and to legal residents of Canada (excluding the Province of Quebec), who are at least eighteen (18) years of age (or the age of majority in their state, province, or territory of residence, whichever is older) at the time of entry and who hold a paid, active BACtrack View subscription at the time of entry and at the time of prize award.
Individuals on a free trial, promotional/discounted rate, or otherwise non-paying subscription are not eligible.
Employees, officers, directors, and agents of Sponsor, its parent companies, subsidiaries, affiliates, and advertising and promotion agencies, and the immediate family members (spouse, parent, child, sibling, and their respective spouses, regardless of where they reside) and those living in the same household of each, are not eligible to enter or win.
Void in Quebec and where prohibited or restricted by law. All applicable federal, state, provincial, and local laws and regulations apply.
3. Promotion Period
The Sweepstakes runs on an ongoing monthly basis. Each "Entry Period" begins at 12:00:00 AM Pacific Time on the first day of a calendar month and ends at 11:59:59 PM Pacific Time on the last day of that same calendar month. Each Entry Period is a separate sweepstakes; a new drawing is held each month. Sponsor's computer is the official time-keeping device for the Sweepstakes.
4. How to Enter
There are two (2) ways to enter. Limit one (1) entry per person per Entry Period per method.
Method 1: Leave a Review (Standard Entry)
During an Entry Period, submit a review of BACtrack View on any of the following channels:
- Apple App Store (BACtrack View app page)
- Google Play Store (BACtrack View app page)
- An on-site review request or email review request sent by Sponsor
- Any other review channel Sponsor solicits during the Entry Period
Reviews must be genuine, in English (or French for Canadian residents outside Quebec), and comply with the applicable review platform's terms of service. Reviews submitted prior to the Entry Period or after it closes are not eligible for that Entry Period.
Method 2: Free Alternate Method of Entry (AMOE)
To enter without leaving a review, hand-print on a 3" x 5" card your full name, complete mailing address, email address, daytime phone number, date of birth, and the statement "BACtrack View Monthly Sweepstakes Entry," and mail it in a #10 envelope with proper postage affixed to:

Each mail-in entry must be mailed separately and postmarked during the Entry Period and received by Sponsor no later than five (5) business days after the Entry Period ends. Mechanically reproduced, illegible, incomplete, or late entries are void. Proof of mailing does not constitute proof of receipt.
Both methods have equal chances of winning.
5. Prize and Approximate Retail Value (ARV)
One (1) prize will be awarded per Entry Period: one (1) free month of BACtrack View subscription service at the winner's then-current paid plan tier. The prize is applied as a one-month credit to the winner's BACtrack View account or, at Sponsor's discretion, as a one-month extension of the winner's paid subscription term. The prize is not a prepaid annual subscription, not a multi-month credit, and not transferable.
BACtrack View paid plans currently range from $79.99 to $129.99 USD per month. Actual value of the prize depends on the winner's plan tier at the time of award.
ARV: up to $129.99 USD (approximately $177 CAD at current exchange rate).
Total ARV of all prizes awarded over any consecutive twelve-month period: up to approximately $1,559.88 USD.
Prize has no cash value and cannot be substituted, transferred, or redeemed for cash, except that Sponsor reserves the right to substitute a prize of equal or greater value if the advertised prize becomes unavailable for any reason. Prize is awarded "as is" with no warranty or guarantee, express or implied. All federal, state, provincial, and local taxes on the prize are the sole responsibility of the winner.
6. Winner Selection and Notification
On or about the tenth (10th) business day following the end of each Entry Period, Sponsor (or its designated representative) will conduct a random drawing from among all eligible entries received during that Entry Period. The potential winner will be notified by email at the address provided with the entry (or on file with Sponsor's review channel for review-based entries) within ten (10) business days of the drawing.
The potential winner must respond to the notification within seven (7) calendar days. Failure to respond, inability to verify eligibility, return of the notification as undeliverable, or refusal of the prize will result in disqualification, and Sponsor reserves the right, at its sole discretion, to select an alternate winner from the remaining eligible entries.
Skill-Testing Question (Canadian Winners Only)
Before being declared a winner, any potential winner who is a Canadian resident must correctly answer, without mechanical or other assistance, a time-limited mathematical skill-testing question administered by Sponsor in writing or by email. Failure to answer the question correctly within the allotted time will result in disqualification and forfeiture of the prize.
7. Odds of Winning
Odds of winning depend on the number of eligible entries received during each Entry Period.
8. Publicity Release
Except where prohibited, acceptance of a prize constitutes the winner's consent for Sponsor to use the winner's first name, last initial, and state or province of residence for promotional purposes in any media, worldwide, without further payment or consideration.
9. General Conditions; Release
By entering, each entrant agrees to be bound by these Official Rules and the decisions of Sponsor, which are final and binding in all matters relating to the Sweepstakes.
Each entrant releases, discharges, and holds harmless Sponsor, its parent companies, subsidiaries, affiliates, and their respective directors, officers, employees, and agents from and against any and all claims, damages, and liabilities of any kind arising out of or in connection with the Sweepstakes or any prize awarded, including without limitation any personal injury, death, property damage, or claims based on publicity rights, defamation, or invasion of privacy.
Sponsor is not responsible for any lost, late, incomplete, illegible, misdirected, undelivered, or garbled entries or notifications, or for any problems with or malfunctions of telephone networks, computer systems, servers, providers, software, or internet connections. Sponsor reserves the right to disqualify any entrant whom Sponsor determines, in its sole discretion, has tampered with the entry process or violated these Official Rules.
Sponsor reserves the right to modify, suspend, or terminate the Sweepstakes at any time if fraud, technical failure, or any other factor beyond Sponsor's reasonable control impairs the integrity of the Sweepstakes, as determined by Sponsor in its sole discretion.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL SPONSOR OR ANY OF ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE SWEEPSTAKES OR ANY PRIZE AWARDED. ENTRANT'S SOLE REMEDY FOR ANY CLAIM AGAINST SPONSOR IS LIMITED TO THE VALUE OF THE ADVERTISED PRIZE.
11. Disputes; Governing Law
Except where prohibited, entrants agree that any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes or any prize awarded will be resolved individually, without resort to any form of class action, and exclusively by the state or federal courts located in San Francisco, California. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes will be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice-of-law or conflict-of-law rules.
Canadian residents: to the extent any provision of these Official Rules is inconsistent with applicable Canadian law, the provisions of applicable Canadian law will govern.
12. Privacy
Personal information collected in connection with the Sweepstakes will be used by Sponsor consistent with its Privacy Policy, available at https://bactrack.com/privacy-policy.
13. Winners List
For the name of the winner of any completed Entry Period, send a self-addressed, stamped envelope to: "BACtrack View Monthly Review Sweepstakes Winners List, 200 Green Street, 2nd Floor, San Francisco, CA 94111." Requests must be received within ninety (90) days after the end of the applicable Entry Period. Residents of Vermont may omit return postage.
